Fulji Trading Inc. ("Fulji Trading", "we", "us", "our") respects your privacy. This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what rights you have.

We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy law.

This Policy applies to www.fuljitrading.com and to all dealings you have with us as a customer, supplier, or applicant for a wholesale account.

1. Accountability - our Privacy Officer

Fulji Trading Inc. is responsible for the personal information under our control. We have designated a Privacy Officer who is accountable for our compliance with this Policy and with PIPEDA.

2. What personal information we collect

2.1 Information you give us. Your name, business name, email address, phone number, billing and delivery addresses, and, where you apply for a wholesale account, information about your business such as business registration details, HST number, and trade references.

2.2 Order information. The products you order, order history, delivery records, and signatures captured at the point of delivery as proof of delivery.

2.3 Payment information. Payments are processed by our third-party payment processor. We do not store your full credit card number on our systems. We receive only limited information such as the last digits of the card, the card type, and whether the payment succeeded.

2.4 Technical information. When you visit our website, our servers and analytics tools automatically record your IP address, browser type, device type, operating system, referring page, and the pages you view.

3. Why we collect it

We collect and use personal information only for the following identified purposes:

  • To take and fulfil your orders - processing payment, picking, delivering, and confirming delivery.
  • To operate your account - assessing wholesale account applications, setting credit terms, and managing your account.
  • To invoice you and collect payment, including pursuing overdue amounts.
  • To provide customer service and respond to your enquiries.
  • To send you marketing communications, where you have consented (see Section 4).
  • To improve our website and products, using aggregated analytics.
  • To meet our legal obligations, including tax, accounting, and food safety record-keeping.

We will not use your personal information for a new purpose without first obtaining your consent, unless the law permits or requires otherwise.

4. Consent, marketing, and how to withdraw

4.1 Consent. By placing an order or opening an account, you consent to us collecting and using your personal information for the purposes in Section 3.

4.2 Marketing emails. We send commercial electronic messages only in accordance with Canada's Anti-Spam Legislation (CASL). We will only send you marketing email where you have given us express consent, or where we have implied consent because you are an existing customer. Every marketing message identifies us, gives our contact information, and contains a working unsubscribe link.

4.3 Withdrawing consent. You may withdraw your consent at any time by contacting our Privacy Officer, subject to legal and contractual restrictions and reasonable notice. Withdrawing consent to essential processing may mean we can no longer supply you.

4.4 Unsubscribing. Unsubscribing from marketing does not stop transactional messages - order confirmations, delivery notifications, and invoices - which are necessary to perform our contract with you.

5. Who we share it with

We do not sell, rent, or trade your personal information.

  • Service providers who act on our behalf, including our website and ERP host (Odoo), our payment processor, our analytics provider (Google), and delivery and logistics partners. They may use your information only to perform services for us, and are bound to protect it.
  • Professional advisors such as our accountants, auditors, and lawyers.
  • Law enforcement or government authorities, where required by law, regulation, subpoena, or court order.
  • An acquiring party, in the event of a merger, acquisition, financing, or sale of all or part of our business, under terms no less protective than this Policy.

6. Storage outside Canada

Your personal information may be stored and processed outside of Canada, including in the United States and the European Union, by our service providers such as our website and ERP host and our payment processor.

While your information is in another country, it is subject to the laws of that country and may be accessible to that country's courts, law enforcement, and national security authorities in accordance with its laws. We take reasonable contractual and technical steps to require our service providers to protect your information to a comparable standard.

7. How long we keep it

  • Order, invoice, and tax records: at least 6 years after the end of the relevant tax year, as required by the Canada Revenue Agency.
  • Account information: while your account is active, and for 2 years after it becomes inactive.
  • Delivery records and signatures: 2 years from the delivery date.
  • Marketing contacts: until you unsubscribe or withdraw consent.
  • Website analytics: as set out in our Cookie Policy.

When personal information is no longer needed, we securely delete or anonymize it.

8. How we protect it

We use physical, organizational, and technical safeguards appropriate to the sensitivity of the information, including encrypted connections (HTTPS), access controls limiting staff access to what their role requires, and reputable hosting and payment providers.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach of security safeguards occurs that creates a real risk of significant harm to you, we will notify you and the Office of the Privacy Commissioner of Canada as required by PIPEDA, and we will keep records of breaches as the law requires.

9. Your rights

9.1 Access. You may ask us what personal information we hold about you, how we use it, and who we have disclosed it to. We will respond within 30 days. In most cases access is free; if a request would involve significant cost, we will tell you the estimated cost before proceeding.

9.2 Correction. If any information we hold is inaccurate or incomplete, tell us and we will correct it, and where appropriate notify third parties who received the incorrect information.

9.3 Deletion. You may ask us to delete your personal information. We will do so unless we are required to retain it - for example, tax and invoice records we must keep for 6 years.

To exercise any of these rights, contact our Privacy Officer. We may ask you to verify your identity first.

10. Complaints

If you are unhappy with how we have handled your personal information, please contact our Privacy Officer first - we will investigate and respond to you.

If you are not satisfied with our response, you have the right to complain to the Office of the Privacy Commissioner of Canada:

11. Children

Our website and products are directed at businesses, not children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact our Privacy Officer and we will delete it.

12. Third-party links

Our website may link to third-party sites. We are not responsible for their privacy practices, and this Policy does not apply to them. Read their privacy policies before providing them with personal information.

13. Changes to this Policy

We may update this Policy from time to time. We will post the updated version on this page and change the effective date at the top. Where changes are significant, we will take reasonable steps to notify you directly.
